Is it a Spring peeper or a toad?

At this time of year I can hear the spring peepers chattering and singing their songs in the evenings. My husband took our small schnauzer out the other evening and several of the peepers jumped into our pool which is not open yet and the water is only rain water .But this little fellow stayed on the deck and my husband got a photo of him I assumed he was a spring peeper. but my husband believes he’s a toad. I am no expert but what do you think??

What’s the verdict? I don’t see frogs or toads but I sure do hear the frogs! We’ve had rainy weather and they serenade from the evenings through early mornings : )
